Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by Pixel Digi Solution Inc. (“we”, “us”, “our”) to our clients (“Client” or “you”). By accessing and using our services, you agree to comply with and be bound by these Terms.
1. Agreement to Terms
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any other terms or policies referenced herein. If you do not agree with these Terms, please refrain from using our services.
2. Services Provided
Pixel Digi Solution Inc. offers a range of services, including but not limited to:
- WordPress and WooCommerce Development
- Shopify Store Development
- Website Maintenance and Support Plans
- UI/UX Design and Branding
- Performance Optimization
- SEO (Search Engine Optimization)
- Digital Marketing (Meta Ads, Google Ads)
- Business/Company Formation Services (in select countries)
- Custom Plugin and API Integration
3. Client Eligibility
You must be at least 18 years old and have the legal authority to enter into a contract. By entering into this Agreement, you confirm that you are eligible to receive our services.
4. Payment and Billing
All services provided by Pixel Digi Solution Inc. require payment in advance unless otherwise agreed upon.
We accept payments via Stripe, PayPal, and Bank Transfer.
Recurring payments for subscription-based services will be charged based on the selected payment plan (monthly/annually).
All payments are non-refundable once the service has commenced, unless agreed otherwise.
Any late payments may result in suspension of services until the outstanding balance is cleared.
5. Refund and Cancellation Policy
Full Refund: Available if canceled before the commencement of work.
Partial Refund: Available if the project is canceled after work has started but before full completion.
No Refund: Once the project is completed or digital assets have been handed over to the Client.
For subscription services, cancellation can occur at any time, but all amounts paid are non-refundable.
6. Service Delivery
The service will begin once the agreement is signed and the initial payment is received.
We provide an estimated delivery timeline for each project; however, we are not responsible for delays caused by the Client’s failure to provide necessary materials or information.
We strive to meet deadlines but are not liable for unforeseen circumstances that may cause delays.
7. Intellectual Property
Upon full payment, the intellectual property of all custom work (designs, code, content) developed specifically for the Client will be transferred to the Client.
Pixel Digi Solution Inc. retains the right to use non-confidential work for portfolio purposes.
All third-party assets or pre-existing assets (themes, plugins, software, etc.) remain the property of their respective owners.
8. Confidentiality
We value your privacy. Any personal or business data shared with us during the project will not be disclosed to any third party without your written consent, unless required by law.
We comply with data protection regulations, including GDPR where applicable.
9. Client Responsibilities
As a Client, you are responsible for:
Providing all necessary information, files, and resources needed to complete the project.
Reviewing and providing feedback on deliverables in a timely manner.
Ensuring that any content provided does not violate any third-party rights, including copyright, trademarks, or patents.
10. Third-Party Tools
Pixel Digi Solution Inc. may use third-party tools and platforms (plugins, APIs, themes) in the delivery of services. While we ensure quality, we are not responsible for the functionality or performance of these third-party tools.
You are responsible for maintaining the necessary licenses for any third-party software.
11. Limitation of Liability
Pixel Digi Solution Inc. is not responsible for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profits or business disruption.
Our total liability, whether in contract, tort, or otherwise, shall be limited to the amount paid by the Client for the specific service causing the liability.
12. Termination
Either party may terminate the contract with written notice.
Upon termination, the Client will pay for all work completed up until that point.
13. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of New York, United States.
Any legal disputes will be resolved in the courts located in Albany, NY.
14. Changes to Terms
Pixel Digi Solution Inc. reserves the right to modify these Terms at any time. Any updates will be posted on our website, and your continued use of the services constitutes acceptance of the updated Terms.
